Investigation

The CMSA considers that one of its core functions is to promote and maintain a high level of market integrity in the interests of market participants and the broader economic community. The CMSA is also obliged under section 10 of the Capital Markets and Securities Act, 1994 (the Act) to, among other things:

    • do all things necessary to ensure that its market is orderly and fair;
    • have adequate arrangements for investigating complaints by investors relating to the transaction of the business of investors on its market; and,
    • have adequate arrangements for monitoring, surveillance and enforcing compliance with Legislation, Rules and Regulations.

The CMS Act, provides the CMSA with broad powers to monitor, investigate and obtain information from market players in the course of complying with the statutory obligations and for the purpose of promoting and maintaining market integrity.
